2D Animation

Please read these Terms and Conditions (“Terms”) carefully before using (fberna20.wixsite.com/website) (the “Site”) or engaging Tablemenace Studios (“we,” “us,” or “our”) for animation services, including character design, storyboarding, background art, teaser series, or other creative and collaborative projects (the “Services”). By using the Site or engaging our Services, you agree to these Terms.

01: Services

Tablemenace Studios provides 2D animation and related creative services on a project or commission basis. The scope, timeline, deliverables, and fees for each project will be agreed upon separately with each client, typically in writing (email or a signed agreement/quote), before work begins.

02: Quotes, Payment, and Cancellations

  • Project quotes are estimates based on the scope discussed and may change if the scope changes.
  • A deposit may be required before work begins, with the balance due upon completion or per an agreed payment schedule.
  • Payment methods and due dates will be specified in the project agreement or invoice.
  • Cancellation by the client after work has begun may forfeit some or all of the deposit to cover work completed, as specified in the project agreement.
  • We reserve the right to pause or decline work on a project if payment terms are not met.

03: Revisions

Each project agreement will specify the number of revision rounds included. Additional revisions beyond what is agreed may incur extra fees, to be discussed and agreed upon before additional work begins.

04: Intellectual Property and Usage Rights

  • Unless otherwise agreed in writing, Tablemenace Studios retains ownership of preliminary sketches, unused concepts, and working files not included in the final agreed deliverables.
  • Upon full payment, the client receives the agreed usage rights to the final delivered artwork/animation, as specified in the project agreement (e.g., for personal use, commercial use, or a specific platform or campaign).
  • Tablemenace Studios retains the right to display completed work in its portfolio, website, social media, and promotional materials, unless the client requests confidentiality in writing and this is agreed to in advance.
  • Clients must have the rights to any materials, characters, scripts, or reference content they provide for a project, and agree not to submit content that infringes on third-party rights.

05: Client Responsibilities

  • Provide clear project briefs, timely feedback, and any reference materials needed to complete the work.
  • Respond to revision requests and approvals within a reasonable timeframe to avoid project delays.
  • Ensure any content or direction provided does not violate applicable law or infringe on third-party rights.

06: Timelines

Estimated delivery timelines will be provided at the start of a project. Timelines are estimates and may shift due to project complexity, revision rounds, or delays in client feedback or materials.

07: Limitation of Liability

To the fullest extent permitted by law, Tablemenace Studios is not liable for any indirect, incidental, or consequential damages arising from the use of the Site or the Services. Our total liability for any claim related to a project is limited to the amount paid by the client for that project.

08: Merchandise

Tablemenace Studios may offer merchandise and apparel featuring original artwork and characters. Purchases of merchandise are subject to the pricing, shipping, and return terms displayed at the time of purchase on the Site.

09: Termination

We reserve the right to decline or terminate a project engagement at our discretion, including for non-payment, unclear or abusive communication, or content requests that conflict with our values or applicable law. In such cases, fees will be handled per the project agreement for work completed to that point.

10: Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles, unless otherwise required by applicable law.

11: Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or engagement of Services after changes are posted constitutes acceptance of the updated Terms.
